The term refers to the spread of learned law (Roman law) in continental Europe from the late Middle Ages to the early modern period, and its process of penetration and assimilation, but the usage of this concept has changed over time. Originally, it was a concept in the field of legal sources in German jurisprudence in the 17th and 18th centuries, and originated from the theory that Roman law was officially introduced into Germany by Emperor Lothair III (von Sprinburg) under Imperial law, which was destroyed by H. Conring, and which was used to explain the validity of Roman law in Germany. In this theory, Roman law in its entirety - as long as it was accompanied by commentaries in the "standard commentary" - was "usu receptum" (received by custom) by the courts.
