This is a representative work by the 19th century German legal scholar Jhering. As the exact title, The Spirit of Roman Law in its Various Stages of Development, suggests, Jhering was a legal historical scholar who viewed law as an expression of the national spirit. He explains the evolutionary process of Roman law, which was born in the Roman state, unified the European world, and was passed down to various places after the fall of Rome, creating a universal culture, not from a legal historical perspective but from a legal philosophical perspective. He got stuck on this conceptual jurisprudence, and the book was left unfinished.

19世紀ドイツの法学者イェーリングの代表的大著。正確な書名『ローマ法の多様な発展段階におけるその精神』からも知れるように、イェーリングは法を民族精神の表れとみる歴史法学者として、ローマ国家に生まれたローマ法はヨーロッパ世界を統一し、ローマ滅亡後も各地に継受されて、普遍的な文化をつくっていった、この進化過程を、法史的ではなくむしろ法哲学的に説く。この概念法学に行き詰まり、本書は未完に終わった。
