Liability for construction works

Japanese: 工作物責任 - こうさくぶつせきにん

Special liability for compensation is established when there is a defect in the installation or maintenance of a structure, such as the collapse of a building, in the event of an accident caused by the structure (Article 717 of the Civil Code). Defect here refers to a lack of safety characteristics or equipment that a structure should normally have, and does not require the presence of negligence. The person who primarily bears this responsibility is the occupant, such as the lessee, of the structure, but if the occupant can prove that they were not negligent, they will be exempt from liability, in which case the owner will be held responsible. In other words, as long as there is a defect, the owner must bear responsibility even if they are not negligent, and this liability is a type of no-fault liability.

建物の崩壊など工作物に起因する事故につき，工作物の設置または保存に瑕疵（かし）がある場合に成立する特別の賠償責任(民法717条)。ここに瑕疵とは，工作物が通常備えるべき安全な性状や設備に欠ける場合を指し，過失の存在を要しない。この責任を第1次的に負担するのは工作物の賃借人など占有者であるが，占有者は無過失を立証すれば免責され，この場合には，所有者が責任を負う。つまり，瑕疵がある以上，所有者は自己に過失がなくても責任を負わねばならず，その責任は一種の無過失責任である。
