Joint Custody Principle

Only minor children are subject to parental authority. If a child is born in wedlock, and both parents are alive and in a normal marital relationship, they will exercise parental authority jointly (the principle of joint custody). If one parent dies, loses parental authority, or is missing and is unable to exercise parental authority, the other parent will become the sole parent (Civil Code Article 818).
