Joint application principle

… In principle, an application for a registration of rights must be made jointly by the person who will directly benefit from the registration (the person entitled to registration) and the person who will be disadvantaged by the registration (the person obligated to register), and the person entitled to registration and the person obligated to register or their representative must appear in person at the registry office (Article 26, paragraph 1). The reason for adopting the joint application system under the current law is that the registrar is not given the so-called substantive examination power to examine the existence of a substantial right relationship in an application for registration, so that the parties to a substantial relationship that requires registration are required to apply for the registration jointly, thereby ensuring the authenticity of the registration. Therefore, in cases where the authenticity of the registration can be guaranteed without a joint application, such as a registration by judgment, or in cases where a joint application is not possible due to the nature of the registration, such as a registration by inheritance or a registration of a change in the name of the registered owner, the registered owner may apply alone. …
