A collection of criminal precedents from the Edo Shogunate. In the Edo Shogunate judicial system, judges such as Bugyo and Daikan were given a limit on the punishments they could impose, and cases that exceeded that limit or were difficult to decide on had to be referred to the Roju. The Roju would refer important cases to the Hyojosho (council of judges) for deliberation, and would use the resulting report as a reference when issuing instructions. The Oshioki Rei Ruishu is a classification of these reports, and can essentially be said to be a collection of precedents from the Edo Shogunate Supreme Court, with extremely excellent editing techniques. It was compiled five times by the Hyojosho, but the fifth edition was destroyed in the Great Kanto Earthquake (1923). The first collection consisted of 30 volumes and was published from 1771 to 1802, the second collection consisted of 31 volumes and was published from 1803 to 1816, the third collection consisted of 37 volumes and was published from 1815 to 1826, and the fourth collection consisted of 65 volumes and was published from 1827 to 1827. They were successively called the Koruishu, Shinruishu, Zokuruishu, and Tenpou Ruishu. 江戸幕府の刑事判例集。江戸幕府の裁判制度では裁判官である奉行(ぶぎょう)、代官などには科しうる刑罰の限度が決まっており、それを超える事件や決定しがたい事件は老中に伺わなければならなかった。老中は、重要な事例は評定所(ひょうじょうしょ)一座に下付して評議させ、その答申である評議書を参考にして指令を与えた。御仕置例類集はこの評議書を類別したもので、実質上、江戸幕府最高裁判所の判例集といってよく、編集技術もきわめて優れている。評定所において5回編集されたが、5回目のものは関東大震災(1923)で焼失した。第1集は明和(めいわ)8年(1771)から享和(きょうわ)2年までの30冊、第2集は享和3年(1803)から文化(ぶんか)11年までの31冊、第3集は文化12年(1815)から文政(ぶんせい)9年までの37冊、第4集は文政10年(1827)から天保(てんぽう)10年までの65冊で、順次、古類集、新類集、続類集、天保類集とよばれた。 [平松義郎] 『『御仕置例類集』全16巻(1971~74・名著出版)』 出典 小学館 日本大百科全書(ニッポニカ)日本大百科全書(ニッポニカ)について 情報 | 凡例 |
