・In the Labor Standards Act, a worker is defined as "a person employed in a business or office, regardless of the type of occupation, who is paid a wage." (Labor Standards Act, Article 9)
・The determination of whether or not someone is an employee is as follows:
(1) The form of labor provided is labor under the direction and control of the employer.
(2) Wages are paid as compensation for labor.
It is judged based on two criteria:
- The practical training during an internship is for observation and experience purposes. If the intern does not receive instructions or orders from the employer, he or she will not be treated as an employee. However, if the intern is directly engaged in production activities, the profits generated by those production activities belong to the workplace in question, and an employment-subordinate relationship is recognized, the intern will be considered an employee. The treatment of students during an internship will be determined based on the actual situation.
- Trainees from other countries who come to Japan for a period of less than one year to acquire skills, techniques, and knowledge are generally not considered workers.

・労働基準法における労働者とは、「職業の種類を問わず、事業又は事務所に使用される者で、賃金を支払われる者」をいう。(労働基準法第9条)
・労働者であるか否かの判断は、
(1)労働提供の形態が使用者の指揮命令かの労働であること。
(2)賃金が労働に対する対価として支払われていること。
の2点の基準で判断される。
・インターシップにおける実習は、見学や体験的なものであり。使用者から業務の指揮命令を受けていなければ、労働者として扱われない。しかし、直接生産活動に従事
し、その生産活動により生じる利益等が当該事業場い帰属し、使用従属関係が認められる場合は労働者に該当する。インターシップ中の学生の取扱いは、実態を持って判断される。
・諸外国から1年以内の期間で、技術・技能・知識を取得しにきた研修生は、基本的には労働者には該当しない。
