A concept in German civil law (and Swiss civil law) that refers to the intrusion of smoke, noise, vibrations, etc. into neighboring land. It does not include obstruction of sunlight or the intrusion of sewage. Under German civil law, ownership rights are protected from all tangible and intangible infringements, and the right to demand removal of the infringement is recognized (German civil code §§ 903, 1004). Furthermore, if the infringement is illegal and is based on intent or negligence, damages can be demanded (§§ 823 et seq.). However, a special obligation to tolerate immission is stipulated. ドイツ民法(およびスイス民法)上の概念で,ばい煙,騒音,震動などが隣地に侵入すること。日照妨害,汚水の侵入は含まない。ドイツ民法上,所有権はあらゆる有形無形の侵害から守られ,妨害排除請求権が認められている(ドイツ民法903,1004条)。また,侵害行為が違法で故意・過失がある場合には損害賠償を請求することができる(823条以下)。しかし,インミッシオンについては特別な受忍義務が規定されている。(1)被害が本質的(〈かなりの程度〉という意味)でなければ,被害者は差止めも損害賠償も請求できない。
