...This is called an organ lawsuit. An organ lawsuit can only be filed when specifically permitted by law (Article 42 of the Administrative Case Litigation Act), and typical examples of organ lawsuits are (1) a mandate lawsuit under Article 151-2 of the Local Autonomy Law, and (2) a lawsuit between an assembly and a mayor under Article 176-7 of the Local Autonomy Law. The former lawsuit seeks to leave to the court a fair judgment a dispute between a local government organ (the mayor or committee) that has been entrusted with the management of national administrative affairs and a national organ such as a minister that has command and supervision authority over those affairs, while the latter lawsuit seeks to fairly resolve a dispute between the mayor and an assembly over the legality of an assembly resolution or election by leaving it to the court's legal judgment.
