During the Meiji period, Japan's coastal fishing industry had reached its peak, but production had plateaued and was in a state of stagnation, so as a countermeasure, it increased its forays into overseas fishing, of which the largest proportion was fishing in the waters around Korea. There were known cases of fishermen from southwestern Japan fishing in the waters around Korea from the early Meiji period, but diplomatic relations between Japan and Korea were cut off for some time after the Meiji Restoration, and the Treaty of Amity between Japan and Korea, ratified in 1876, did not include a fisheries treaty, and it was not until the Regulations for Fishing Traffic between Japan and Korea were promulgated in 1890, following the provisions of the Japan-Korea Trade Treaty concluded in 1883, that the treaty came into existence. 明治期の日本漁業は沿岸漁業が爛熟期に達し,その生産が頭打ち,伸び悩み状態に立ちいたったので,対応策の一つとして海外漁業への進出が増加し,中でも朝鮮近海への出漁が最大の比重を占めた。明治初年から西南日本の漁民で朝鮮近海に出漁した事例は知られていたが,明治維新後しばらくは日韓両国の国交は絶えていたし,1876年に批准された日朝修好条規には漁業条約がなく,それが日の目をみたのは83年締結の日鮮貿易条約の規定をうけて,90年に日本朝鮮両国通漁規則が公布されてからである。
