Search of the house - kataku sosaku

It refers to entering a person's residence to search for items to be seized or for a person to be arrested, subpoenaed, or detained. When necessary for the investigation of a crime, a public prosecutor, a public prosecutor's assistant officer, or a judicial police officer may conduct a search of a home with a warrant issued by a judge (Criminal Procedure Code, Article 218). However, a warrant is not required when a search is conducted in conjunction with an arrest (Criminal Procedure Code, Article 220). When searching the residence of a person other than the suspect, a search may be conducted only when there are circumstances sufficient to confirm the presence of items to be seized (Criminal Procedure Code, Articles 102, Paragraph 2, and 222, Paragraph 1). The court may also conduct a search with a warrant of the defendant's residence when necessary, and of the residence of a person other than the defendant, only when there are circumstances sufficient to confirm the presence of items to be seized (Criminal Procedure Code, Articles 102, 106, and see Article 126).

人の住居に立ち入って、押収すべき物、または逮捕・勾引(こういん)もしくは勾留すべき人を、捜索することをいう。検察官、検察事務官または司法警察職員は、犯罪の捜査のために必要があるときは、裁判官の発する令状により家宅捜索をすることができる（刑事訴訟法218条）。ただし、逮捕に伴って捜索する場合には、令状を必要としない（同法220条）。被疑者以外の者の住居について捜索する場合には、押収すべき物の存在を認めるに足りる状況のある場合に限って捜索することができる（同法102条2項、222条1項）。裁判所も、被告人の住居については必要がある場合に、被告人以外の者の住居については押収すべき物の存在を認めるに足りる状況のある場合に限り、令状により捜索することができる（同法102条、106条、なお126条参照）。
