Tomoo Odaka

Legal philosopher. Born in Busan on January 28, 1899. After graduating from the Department of Political Science, Faculty of Law, Tokyo Imperial University in 1923, he entered the Department of Philosophy, Faculty of Letters, Kyoto Imperial University, graduating in 1928. In the same year, he became an assistant professor at Keijo Imperial University, and a professor in 1930. In 1944, he became a professor at Tokyo Imperial University, where he taught legal philosophy. During this time, from 1928 to 1932, he studied in Germany and Austria, where he studied under Kelsen and E. Husserl. He published many books and papers, and made significant contributions to legal philosophy and the world of legal thought, including issues regarding the binding power of law, the relationship between law and politics, and issues regarding democracy. He also served as a member of the Japan Academy, a member of the Science Council of Japan, and chairman of the Japanese National Committee for UNESCO. He died suddenly in Tokyo on May 15, 1981, from the penicillin shock. His major works include "Legal Philosophy" (1925), "National Structure Theory" (1926), which became his doctoral thesis, "What Lies at the Ultimate Point of Law" (1947), "Liberty Theory" (1952), and "Revised Introduction to Legal Philosophy" (1952). His younger brother was Odaka Naotada.

法哲学者。明治32年1月28日釜山(ふざん/プサン)に生まれる。1923年東京帝国大学法学部政治学科を卒業後、京都帝国大学文学部哲学科に入り、28年に卒業、同年京城(けいじょう)帝国大学助教授、30年教授を経て、44年東京帝大教授となり、法哲学講座を担当した。この間28年から32年にかけて、ドイツ、オーストリアに留学、ケルゼン、E・フッサールに師事した。著書、論文は多数に上り、法の拘束力に関する問題、法と政治の関係についての問題、民主主義に関する問題をはじめとして、法哲学、法思想界に大きく貢献した。また、日本学士院会員、日本学術会議委員、日本ユネスコ国内委員会委員長としても活躍した。56年5月15日ペニシリン・ショックにより東京で急死。主要著書は『法哲学』(1925)、学位論文となった『国家構造論』(1926)、『法の窮極にあるもの』(1947)、『自由論』(1952)、『改訂法哲学概論』(1952)など。なお、尾高尚忠は弟。
