Legislative state - Rippo kokka
Modern post-revolution states are based on the premise that all exercise of state power is based on law, and that law is established by the parliament, which represents the people. This means that parliamentary legislation is the legal starting point for the exercise of state power, and it follows logically that parliament is the highest organ. A state with this structure is called a legislative state, and from a historical perspective, it is generally said that 19th century states were legislative states. This is because modern states have taken on the characteristics of states in which the executive is superior (administrative states) or states in which the courts determine the legality of actions by all state organs (judicial states).

近代市民革命後の国家は,すべての国家権力の行使が法に基づくこと,そしてその法が国民の代表である議会によって定められることをたてまえとしている。そのことは,議会の立法が国家権力行使の法的起点となることを意味し,議会の最高機関性が論理的に導かれる。こうした構造の国家を立法国家とよび,歴史的段階からみて,一般的には19世紀国家が立法国家であったといわれる。けだし,現代国家は,行政の優位する国家(行政国家),あるいは,裁判所にすべての国家機関による行為の適性法を判断させる国家(司法国家)の様相を帯びているからである。
