Along with the Trucking Business Law (Law No. 83 of 1989), this law aims to promote the public welfare through the comprehensive development of road transportation by ensuring the proper operation of road transportation businesses (passenger truck transportation businesses, trucking businesses, and highway businesses), fair competition, and order in road transportation. Law No. 183 of 1951. The main contents are as follows: (1) Matters relating to passenger automobile transportation businesses, such as types of passenger automobile transportation businesses, business licenses and notifications, approval and notification of fares and charges, approval of changes to transportation terms and conditions and business plans, obligations to undertake transportation, operations managers, employees, transportation safety, orders to improve businesses, and suspension and termination of businesses. (2) Matters relating to highways and highway businesses, such as licenses for highway businesses, construction work, technical standards, inspection of structures and facilities, approval of usage fees, and approval of changes to service terms and conditions and business plans. (3) Matters relating to national highway operations. (4) Matters relating to the use of private automobiles, such as registration for paid passenger transportation and restrictions on rental. The revised law that came into force in February 2002 relaxed regulations on bus business entry by changing from a license system to a permission system, changing suspension and closure from a permission system to a six-month advance notification system, and changing fares from an approval system to an advance notification system with an upper approved range. The revised law that came into force in October 2006 introduced a registration system for chartered replacement buses by local governments, operation of new community buses, and paid welfare transportation in private cars by NPOs (non-profit organizations) and the like. 貨物自動車運送事業法(平成1年法律第83号)とともに、道路運送事業(旅客自動車運送事業、貨物自動車運送事業、自動車道事業)の適切な運営、公正な競争、道路運送に関する秩序を確保することにより、道路運送の総合的な発達を通じて公共の福祉を増進することを目的とする法律。昭和26年法律第183号。 おもな内容は次の通りである。 (1)旅客自動車運送事業の種類、事業の許可・届出、運賃・料金の認可・届出、運送約款・事業計画の変更の認可、運送引受け義務、運行管理者、従業員、輸送の安全、事業の改善命令、事業の休止・廃止など旅客自動車運送事業に関する事項。 (2)自動車道事業の免許、工事施行、技術上の基準、構造設備の検査、使用料金の認可、供用約款・事業計画の変更の認可など自動車道、自動車道事業に関する事項。 (3)国営自動車道事業に関する事項。 (4)自家用自動車の使用に関する有償旅客運送の登録、賃貸の制限など自家用自動車の使用に関する事項。 2002年(平成14)2月施行の改正法では、バス事業の参入規制が免許制から許可制へ、休廃止を許可制から6か月前までの事前届出制へ、運賃を認可制から上限認可範囲内の事前届出制とする等の規制緩和が行われた。2006年10月施行の改正法では自治体による貸切代替バスや新たなコミュニティバスの運行、およびNPO(民間非営利組織)等による自家用自動車での福祉有償運送などが登録制として導入された。 [天野和治・土居靖範] [参照項目] | | |出典 小学館 日本大百科全書(ニッポニカ)日本大百科全書(ニッポニカ)について 情報 | 凡例 |
