Registration - Registration

It is a type of administrative prior regulation, and is an intermediate system between the notification system and the license system. Registration is granted if certain objective criteria are met, but registration is revoked if certain items are violated. Examples include the Travel Agency Act, the Agricultural Chemicals Control Act, the Lawyer Act, the Money Lending Business Act, and the Administrative Scrivener Act. For example, under the Travel Agency Act, anyone who wishes to operate a travel business must be registered by the Commissioner of the Japan Tourism Agency. Registration is denied for those who have a certain criminal history and have not yet completed the sentence within five years, those who have had their registration revoked and have not yet passed five years from the date of revocation, those who have committed fraudulent acts in the travel business within five years prior to application, adult wards, persons under guardianship, and bankrupt persons who have not been reinstated. Registration is not denied for ordinary people. Circumstances such as an excessive number of competitors or opposition from competitors are not grounds for refusal of registration. Registration usually has a validity period. Operating without registration will be punished. Registered businesses may have their registration revoked or their operations suspended if they fall under one of the grounds for refusal of registration or if they commit certain fraudulent acts.

行政上の事前規制の手法の一種で、いわば届出制と許可制の中間的な仕組み。登録は一定の客観的な基準に合致すれば認められるが、一定事項違反に対しては登録が取り消される。旅行業法、農薬取締法、弁護士法、貸金業法、行政書士法などがその例である。たとえば、旅行業法では、旅行業を営もうとする者は観光庁長官の行う登録を受けなければならない。一定の犯罪歴があり刑の執行を終えてから5年を経過していない者、登録取消の前歴があり取消の日から5年を経過していない者、申請前5年以内に旅行業務に関し不正な行為をした者、成年被後見人、被保佐人、破産者で復権を得ない者などは登録を拒否される。通常人であれば登録を拒否されることはない。同業者が過剰だ、競争業者が反対しているという事情などは登録の拒否事由にならない。登録には有効期間があるのが普通である。登録なしで営業すると処罰される。登録業者は登録拒否事由に該当するに至ったときのほか、一定の不正行為をしたときなどに登録を取り消されたり、営業停止される。
