Imperial decree - chokurei

A general term for the orders (a form of law) enacted by the Emperor under the Meiji Constitution. The Emperor was in a position to exercise sovereignty, and therefore could issue Imperial decrees with the advice of the Cabinet. In addition to the currently recognized executive orders and delegated orders, the Emperor could also issue independent orders and emergency orders. The Prime Minister countersigned these decrees together with the relevant Minister of State. Furthermore, as a result of the broad scope of matters of sovereignty being recognized, the matters that could be determined by Imperial decrees were also extremely broad. The Constitution of Japan does not recognize Imperial decrees. Therefore, among the Imperial decrees that were in effect at the time the current Constitution came into effect, those that contained matters that should have been stipulated by law were allowed to have provisional effect for a certain period of time as a transitional measure.

明治憲法下において、天皇によって制定された命令（法形式の一つ）の総称。天皇は統治権を行使する地位にあり、そのため内閣の輔弼(ほひつ)により勅令を発することができたのであるが、その形式も、現在認められている執行命令、委任命令のほか、独立命令や緊急命令を発することができた。そして内閣総理大臣が主任の国務大臣とともにこれに副署した。また、大権事項が広範に認められたことの結果として、勅令で定めうる事項もきわめて広かった。日本国憲法は勅令を認めていない。そのため、現行憲法施行の際に効力をもっていた勅令のうち、法律で規定しなければならない事項を内容とするものについては、経過的措置として、一定期間暫定的効力を認められた。
