Under the Civil Procedure Law, a judgment is made during a trial on a litigation or substantive issue that is the basis for a final judgment. Whether or not to make such a judgment is left to the discretion of the court. The matters that are subject to such judgment include those regarding independent methods of attack and defense, interlocutory disputes, and causes of claims. An interlocutory judgment is binding on the court in making a final judgment. Since an interlocutory judgment cannot be appealed independently, it can be appealed by appealing a final judgment.

民事訴訟法上，審理の途中で，終局判決の前提となる訴訟上または実体上の争点についてなされる判決。これを行なうか否かは，裁判所の裁量にゆだねられる。対象となる事項には，独立した攻撃防御の方法に関するもの，中間の争いに関するもの，請求の原因に関するものがある。中間判決は，終局判決をなすについて当該裁判所を拘束する。中間判決は独立して上訴できないので，終局判決に対する上訴で不服を申し立てることになる。
