Interim interest - Interim interest

When a bankruptcy is declared, the debtor loses the benefit of the term (Bankruptcy Act, Article 17), so creditors can exercise as bankruptcy claims even those claims that become due after the bankruptcy is declared (and thus are future). In this case, the amount of the claim is the current value, not the value when the due date arrives. For example, the current value of a claim to be paid 1 million yen in 10 years is not 1 million yen, but the amount obtained by deducting the interim profits over those 10 years. In this way, the interim profits that are deducted from the amount of a claim that is intended to provide a certain payment in the future in order to calculate the current value of that claim is called interim interest.

破産宣告があると債務者は期限の利益を失うから(破産法17条)，債権者は，破産宣告後に期限の到来する(その意味で将来の)債権でも，破産債権として行使できる。この場合の債権額は，期限が到来したときの価額ではなく，現在の価額である。たとえば，10年後に100万円支払うという債権の現在の価額は，100万円ではなく，そこからこの10年間の中間利益を控除した額である。このように，将来の一定の給付を目的とする債権の現在の時点での価額を算定するために，その給付額から控除される中間の利益を中間利息と呼ぶ。
