Principle of Good Faith -

This principle requires that rights and obligations must be exercised in good faith and in good faith (Civil Code, Article 1, Paragraph 2). It is also called the principle of good faith. Good faith means acting in good faith as members of a community so as not to betray the trust of others, and is a fundamental principle that governs the law of obligations. For example, if the performance of an obligation is contrary to good faith, the obligation is not fulfilled and the party must bear responsibility for the default. In this way, the principle of good faith not only serves as a principle for the actions of parties, but also serves as a principle for the interpretation of law and contracts, and even as a legislative principle.

権利の行使および義務の履行は信義に従い誠実にこれをなすことを要する、とする原則（民法1条2項）。信義則ともいう。信義誠実とは、社会共同生活の一員として互いに相手の信頼を裏切らないように誠意をもって行動することであり、債権法を支配する大原則である。たとえば、債務の履行が信義誠実に反する場合には、債務を履行したことにならず、債務不履行の責任を負わなければならない。信義誠実の原則は、このように当事者間の行動の原則として作用するだけでなく、法律および契約解釈の原理として、さらには立法的原理としても作用するのである。
