Intertemporal law - Jisaiho

When laws are amended or abolished, or the national legal order is renewed, two legal orders or rules that are in a temporal relationship cannot coexist. Since laws must be unified, a legal principle is needed to determine which of the conflicting legal orders or rules applies. This is called intertemporal law. Generally, a written solution is provided by transitional provisions, but there is also an unwritten legal principle that higher laws take precedence over lower laws, and between laws that have the same formal effect, such as between laws, later laws abolish earlier laws, but special laws take precedence over general laws. In addition, facts that were completed under the old law are generally not affected by the new law (the principle of non-retroactivity of law), but retroactive legislation that benefits the other party, such as the law to increase the base salary of public servants, is permitted.

法の改廃や国家法秩序の一新の際は時間的に先後関係にある二つの法秩序や法規が両立しないことが生ずる。法は統一的でなければならないから、この場合にこの矛盾する法秩序ないし法規のいずれが適用されるかを定める法原則が必要である。これを時際法という。一般には経過規定により明文の解決がなされるほか、上位法は下位法に優先し、同一の形式的効力をもつ法規、たとえば法律と法律との間では、後法は前法を廃するが、特別法は一般法に優先するという不文の法原則がある。また、旧法時代に完結した事実は新法の影響を受けないのが原則であるが（法不遡及(ふそきゅう)の原則）、公務員給与のベースアップ法のように相手方に利益となる遡及立法は許される。
