Paul Koschaker
1879‐1951
German legal historian. Born in Klagenfurt, Austria. After graduating from the University of Graz, he went to the University of Leipzig to study under Ludwig Mitteis, whose legal papyrus studies opened up new horizons in the study of Roman law. He taught at universities in Prague, Leipzig, Berlin, and other places. As well as being a leading authority on Roman law, he also made groundbreaking achievements in the study of ancient Oriental laws, particularly pioneering the previously unexplored field of cuneiform law. His research was supported by a strong interest in past modes of legal thinking, and his methodology was characterized by comparative legal history.

ドイツの法制史家。オーストリアのクラーゲンフルトの生れ。グラーツ大学卒業後,ライプチヒ大学に赴き,法パピルス学によりローマ法研究に新生面を開いたミッタイスLudwig Mitteisに師事。プラハ,ライプチヒ,ベルリン等の諸大学で教鞭をとった。ローマ法研究の第一人者であるとともに,古代オリエント諸法の研究に画期的業績を残し,なかんずく楔形文字法という前人未到の領域を開拓した。その研究は過去の法律的思惟様式に対する強い関心によって支えられ,方法的には比較法史的考察を特色とした。
