An association that is not different from an incorporated association in substance, but is not recognized as having legal capacity under the law. Until the Intermediate Corporation Law was enacted in 2001, only those with profit-making or public interest purposes could be recognized as incorporated associations, and this resulted in the creation of such an association. Examples include alumni associations, clubs, and volunteer groups. In the past, it was understood that the rules for unions applied to such associations, but now it is considered that they should be treated as similar to incorporated associations as much as possible. 実体においては社団法人と異ならないが,法律上権利能力を認められない社団。2001年中間法人法が制定されるまでは,社団法人として認められるのは営利か公益を目的とするもののみであったため,これが生ずることとなった。同窓会,クラブ,ボランティア団体など。以前は組合の規定が適用されると解されたが,現在はできるだけ社団法人と同じ取扱いがなされるべきだとされる。なお,当事者能力は明文で認められている(民事訴訟法29条)。→NPO
