Japanese: 苅田狼藉 - かりたろうぜき

Harvesting crops from the rice fields is a legitimate act of harvesting. Even when there was a dispute with another person, the act of "harvesting" was not considered to be illegal in the Middle Ages as self-help, even if one claimed to have a pedigree. Jhering also argued that self-help was simply a forceful restoration of rights, and that as an exercise of force deeply rooted in simple justice, it was necessary to harmonize with an orderly judicial system. However, in Japan, from the latter half of the Kamakura period, when a person had a rival and appealed to the shogunate, it came to be called "rowdy behavior" because it was an exercise of force while the judgment was pending, and disrupted social order, and was subject to punishment from 1310 (Enkei 3).

田の作物を苅り取ることは収穫という正当な行為である。他人と争いがあるときでも，自己に由緒ありという主張のもとにそれを行う〈苅田〉行為は，中世では自力救済として不法行為とはみなされなかった。イェーリングも自力救済は単なる力ずくの権利の回復であって，素朴な正義に深く根ざした実力行使として秩序ある司法制度と調和する必然性があると説いている。しかし，日本では鎌倉後半期より，対抗する相手があって，幕府に訴えたときは，判断の未済の間にする実力行使として，社会秩序を乱すため〈狼藉〉と呼ばれるようになり，1310年(延慶3)以来処罰の対象とされた。
