...A system in which a court declares and publicly announces that a debtor who does not have the financial means to repay his debt even after forced execution is a dispossessor of the family property. Modeled on the French déconfiture system, it was enacted in the Family Property Disposal Law of 1890 and continued until it was abolished by the current Bankruptcy Law in 1922. The legislators' intention was to limit the subjects of family property dispersion to non-merchants, in response to the fact that the bankruptcy system at the time (promulgated in 1890, the old Commercial Code Bankruptcy Section, put into effect in 1893) limited the subjects of bankruptcy declarations to merchants (the so-called merchant bankruptcy principle), but in reality it was also applied to merchants. ...
