A general term for crimes related to "obscenity," roughly equivalent to the group of crimes known in criminology as sex crimes. They can be broadly categorized as follows (note that with the modernization of the Penal Code in 1995, the previous term "obscenity crime" was changed to "obscene crime"). (1) Public indecency crime: The crime of publicly performing obscene acts, with a penalty of imprisonment of up to six months, a fine of up to 300,000 yen, detention, or a fine (Article 174 of the Penal Code). (2) Distribution of obscene materials, etc.: The crime of distributing, selling, publicly displaying, or possessing obscene documents, drawings, or other materials with the intent to sell, with a penalty of imprisonment of up to two years, a fine of up to 2.5 million yen, or a fine (Article 175). 〈猥褻(わいせつ)〉に関わる犯罪の総称で,犯罪学上性犯罪といわれる一群の犯罪にほぼ相当する。それは,以下のように大別できる(なお,1995年刑法の表記現代化にともない,従来の〈猥褻罪〉を〈わいせつ罪〉と改めた)。(1)公然わいせつ罪 公然とわいせつな行為を行う罪で,刑は6ヵ月以下の懲役もしくは30万円以下の罰金または拘留もしくは科料(刑法174条)。(2)わいせつ物頒布罪等 わいせつな文書,図画その他の物を頒布,販売,公然陳列または販売目的で所持する罪で,刑は2年以下の懲役または250万円以下の罰金もしくは科料(175条)。
