A type of illegal judicial action characteristic of the Middle Ages, especially the first half of the period. It refers to the act of a person with a cause of action entrusting the lawsuit to a third party (sayaso), without becoming a party to the lawsuit himself, and the third party who receives the entrustment accepts the lawsuit (takes on the case), and then works to realize the right to sue. There are two types of yosasa, depending on the means used by the person who takes on the case to carry it out. (1) Yosasa conducted in courts such as the Imperial Court and the Shogunate. When the original plaintiff lacks the capacity to be a party to the court or has no hope of winning through normal means, the plaintiff tries to win the case by entrusting the case to a powerful person in that court. 中世,とくにその前半期に特徴的に行われた違法な裁判行為の一つ。訴因をもつものがみずから当事者となることなく,訴を第三者に委託し(沙汰を寄せる),委託を受けたものがこれを受託し(沙汰を請け取る),以後この訴権の実現につとめる行為をいう。沙汰を請け取ったものが寄沙汰を実行する手段によって2種に分かれる。(1)朝廷や幕府などの法廷において行われる寄沙汰。本来の訴人がその法廷での当事者能力に欠ける場合や,通常の手段では勝訴の期待をもちえない場合,その法廷での有勢者に沙汰を寄せて勝訴をかちとろうとするもの。
