Protective custody - Hogoazukari

A financial institution receives a certain fee to store assets such as securities, precious metals, jewels, and important documents from customers in order to prevent accidents such as fire, theft, and loss. Article 10 of the Banking Act provides for safe custody. In the broad sense, there are three types of safe custody: (1) open deposit (sealed deposit), (2) sealed deposit, and (3) safe deposit box. Of these, anything other than (3) is safe custody in the narrow sense. (1) is when the deposited item is stored in an open state with the contents clearly stated, (2) is when the deposited item is stored in a sealed bag or box, and (3) is when a safe deposit box installed in the bank's safe is loaned to the customer for use.

There are various types of safe deposit boxes, including full safe deposit boxes, simple safe deposit boxes, and safety cases. In terms of legal nature, (1) and (2) are paid safekeeping contracts, and (3) is a rental contract for a protective box. In addition, protective custody is considered an ancillary service in banking operations.

金融機関が顧客から有価証券、貴金属、宝石、重要書類などの財産を、火災、盗難、紛失などの事故を防ぐために、一定の手数料をもらって保管する業務。銀行法第10条に保護預りの規定がある。広義の保護預りには、(1)披封(ひふう)預り(開封預り)、(2)封緘(ふうかん)預り、(3)貸金庫の3種があり、このうち(3)を除いたものが狭義の保護預りである。(1)はその内容を明示して寄託物を開封したまま預るもの、(2)は寄託物を密封した袋または箱に入れたまま預るもの、(3)は銀行の金庫室内に設置されている保護箱を貸与して顧客に使用させるものである。

 なお、貸金庫には、本貸金庫、簡易貸金庫、セーフティケースなどの種類がある。法律的な性格としては、(1)と(2)は有償の保管寄託契約、(3)は保護箱の賃貸借契約である。また、保護預りは銀行業務上は付随業務として位置づけられる。
