Freedom of expression, especially the act of communicating facts. Because newspapers and broadcasting play a major role as media for communicating facts to the public, freedom of the press often becomes an issue in relation to newspapers and broadcasting. Today, there is virtually no disagreement that freedom of the press is included in the freedom of expression guaranteed by Article 21 of the Constitution of Japan. However, the argument that this freedom precludes illegality in news gathering activities has not yet been accepted. 表現行為のうち特に事実を伝達する行為の自由。国民に対して事実を伝達する媒体として新聞や放送が大きな役割を果しているところから,報道の自由も新聞,放送との関係で問題となることが多い。日本国憲法 21条の保障する表現の自由のなかに報道の自由が含まれることについては,今日ほぼ異説はない。ただ,この自由が取材活動における違法性を阻却する主張はいまだに承認されていない。
