A court order aimed at eliminating an illegal situation is one of the equitable remedies in Anglo-American law. It usually takes the form of an injunction to stop illegal acts, from which the term "injunction" comes, but in some cases it can also be an order to do something to remove an illegal situation - a mandatory injunction. 違法な状態を消滅させることを目的とする裁判所の命令で,英米法におけるエクイティ(衡平法)上の救済手段の一つ。通常は違法な行為の差止めという形をとり,〈差止命令〉という訳もそれに由来するが,場合により違法状態の除去のためにある行為をなすことを命ずること――作為的差止命令mandatory injunction――もある。インジャンクションには〈仮差止命令preliminary(またはinterlocutoryもしくはtemporary) injunction〉と〈本案的差止命令permanent(またはperpetual) injunction〉の2種類がある。
