Crime of harboring a criminal

A type of crime that undermines the criminal justice system of the state. It is a crime of harboring or helping someone who has committed a crime punishable by a fine or more (statutory penalty) or who has escaped from detention, and is punishable by imprisonment for up to two years or a fine of up to 200,000 yen (Article 103 of the Penal Code). Some interpret "a person who has committed a crime" as including a person under investigation for suspicion of a crime, but it should be limited to the real criminal or at least those who are suspected of being the real criminal. "Harboring" means providing a place to avoid detection and arrest by authorities, while "helping someone to hide" refers to any other method of harboring, such as providing travel expenses necessary for escape, providing clothing and accessories for disguise, or making a false declaration of a substitute criminal, to help someone avoid detection and arrest by authorities.

国家の刑事司法作用を害する罪の一種。罰金以上の刑(法定刑)にあたる罪を犯した者または拘禁中に逃走した者を蔵匿したり、隠避させる罪で、2年以下の懲役または20万円以下の罰金に処せられる(刑法103条)。「罪を犯した者」とは、犯罪の嫌疑により捜査中の者を含むと解する見解があるが、真犯人か、少なくとも真犯人であると疑うに足りる者に限定されるべきであろう。「蔵匿」とは、官憲の発見・逮捕を免れる場所を提供することをいい、また「隠避させる」とは、蔵匿以外の方法、たとえば逃走に必要な旅費を支給するとか、変装用の衣類・装身具等を供与するとか、身代り犯人として虚偽の申告をするなど、官憲の発見・逮捕を免れさせる行為をさす。
