A labor contract is a bilateral contract between "submitting labor" (provision of labor) and "providing remuneration" (payment of wages). The obligation to provide labor defines the scope of labor to be provided by the working hours, place, job type, and duties. When this obligation to provide labor is fully fulfilled as planned in the contract, the employer assumes a specific obligation to pay wages corresponding to this. If the obligation to provide labor is not fulfilled due to the worker's fault, the corresponding obligation to pay wages does not arise. This is called the "no work no pay principle." 労働契約は,〈労務ニ服スルコト〉(労働提供)と〈報酬ヲ与フルコト〉(賃金支払)との双務契約である。労働提供債務は,労働時間・場所・職種職務によってその提供すべき労働の範囲を画される。この労働提供債務を契約で予定されたとおりに完全に履行すると,使用者はこれに具体的に対応する賃金支払債務を負う。労働提供債務が労働者の責任により履行されない場合は,これに対応する賃金支払債務を発生しない。これを〈ノーワーク・ノーペイno work no payの原則〉とよぶ。
