Dunning - Tokusoku

Under tax law, when a taxpayer does not pay the tax by the due date, a demand is made by specifying a deadline as a prerequisite for tax delinquency procedures (Article 37 of the National Tax General Law, Article 66 of the Local Tax Law). In the case of self-assessment tax, a demand is made when the tax amount determined by declaration, correction, or decision is not paid by the due date. In the case of assessment tax and local taxes by ordinary collection, the national or local government determines the tax amount by assessment and requests the taxpayer to pay by an act called a tax notice, but a demand is made when the taxpayer does not voluntarily pay the tax. A demand is a formal act by a demand letter, and an oral demand is invalid. In principle, a demand must be made within 20 days of the due date. In addition, if the taxpayer does not pay the tax within a certain period (usually 10 days) from the date of the demand letter, a tax delinquency procedure will be carried out.

税法上、納税者が納付すべき租税を納期限までに完納しない場合に、滞納処分の前提として、期限を指定してその納付を催告する行為をいう（国税通則法37条、地方税法66条）。申告納税方式の租税の場合には、申告・更正または決定によって確定した税額が納期限までに納付されないときに督促がなされる。また、賦課課税方式による租税および普通徴収の地方税の場合には、国または地方公共団体は賦課決定により税額を確定するとともに、納税の告知とよばれる行為によって納税義務者にその納付を請求するが、それに対して納税者から任意の納税が行われないときに督促がなされる。督促は、督促状による要式行為であって、口頭による督促は無効とされる。督促は、原則として納期限から20日以内になされなければならない。なお、督促状を発した日から一定期日（通常は10日）以内に納税者が当該租税を完納しない場合には、滞納処分がなされる。
