Japanese: 渉外訴訟 - しょうがいそしょう

In the broadest sense, it refers to a lawsuit that contains at least one international element. A lawsuit can be international in this sense when, for example, one or both of the plaintiff and defendant are foreign nationals or have an address in a foreign country, or when the legal relationship at issue in the lawsuit has close ties to a foreign society. International lawsuits usually refer to international civil lawsuits, in which issues arise such as which country's law should be applied (choice of governing law, an issue in private international law) and the recognition of judgments made in foreign countries (foreign judgments).

最も広義には一つでも渉外(国際)的要素を含む訴訟をいう。この意味での訴訟の渉外性は，たとえば原告･被告の一方または双方が外国人であったり，外国に住所を有していたりすることや，訴訟上争われる法律関係が，外国の社会と密接な関係を有することによってもたらされる。渉外訴訟といえば通常は国際的な民事訴訟をさし，そこでは一体どこの国の法律を適用すべきか(国際私法学が問題とする準拠法の選択)の点や外国でなされた判決の承認(外国判決)などが問題となる。
