When a crime or delinquency is committed, the traditional way to resolve it is to go through an investigation stage, then bring the case to the court, i.e., a judicial institution, and take legal action, such as punishment or protective measures. However, putting all cases through the court process is not only wasteful but also inappropriate, because being subjected to the judicial process often causes disadvantages to the individual and prevents them from returning to a healthy social life. 犯罪や非行が行われた場合,捜査の段階を経て,事件を裁判所,すなわち司法機関に持ち込み,刑罰,保護処分など,法律の定める処置を行うのが,伝統的な解決方法である。しかし,すべての事件を裁判所の手続にのせることは不経済であるだけでなく,不適当でもある。なぜなら,司法過程に置かれたことによって,本人が不利益を受け,健全な社会生活への復帰を妨げられることも少なくないからである。そこで,裁判所の手続が始まる以前の段階で事件を処理しようという考え方が生まれた。
