Criticism of the trial

Ordinary citizens criticize the content of trials in specific cases through speech. For sincere criticism of trials to be effective, the conditions are the will of the critic to correct the violation of human rights caused by a miscarriage of justice, the idea of popular sovereignty, that trials are conducted based on the people's trust, and the guarantee of freedom of speech. In France, Voltaire was already an enthusiastic critic of trials in the 18th century, but Zola's activities during the Dreyfus Affair at the end of the 19th century are particularly well known. In the United States, the Sacco-Vanzetti trial (1921) was subject to much criticism, and a well-known example is the state governor's announcement that the defendants' honors would be rehabilitated 50 years after their execution.

一般国民が，言論を通じて，特定の事件についての裁判の内容を批判すること。真摯（しんし）な裁判批判が成立するためには，誤判による人権侵害をただそうとする批判者の意思と，裁判が国民の付託に基づいて行われるという国民主権の思想，そして言論の自由の保障が条件となる。フランスでは，すでに18世紀にボルテールが熱心な裁判批判を行っていたが，19世紀末に起きたドレフュス事件におけるゾラの活動がとくに有名である。アメリカでは，サッコ=バンゼッティ事件の裁判(1921)に対して多くの批判が加えられ，死刑執行後50年を経て州知事が被告人らの名誉回復を宣言した例がよく知られている。
