When a legal dispute arises, a private individual has the right to sue a court to protect his or her rights and interests, and to have the dispute resolved by a court. Article 32 of the Constitution of Japan guarantees this right as one of the fundamental human rights. The guarantee of this right is based on the fact that modern states have given the courts the role of realizing justice, and have formed and developed a system of courts and judges that fulfills this role independent of any pressure. Therefore, courts must always conduct fair and impartial trials without betraying people's trust in them, and must not neglect or refuse to try formal complaints. 法律上の争いが生じたとき,私人が自己の権利や利益を守るため裁判所に訴えて,裁判によりその争いを解決してもらう権利。日本国憲法32条は,この権利を基本的人権の一つとして保障している。この権利の保障は,近代国家が正義の実現をはかる役割を裁判所に与え,いかなる圧力からも独立してその役割を果たす裁判所および裁判官の制度を形成,発展させたことを背景としている。したがって,裁判所は,裁判への信頼を裏切ることなくつねに公正・公平な裁判を行わなければならず,また,正式の訴えに対して裁判を怠ったり拒絶をしてはならない。
