When a legal dispute arises, a private individual has the right to sue a court to protect his or her rights and interests, and to have the dispute resolved by a court. Article 32 of the Constitution of Japan guarantees this right as one of the fundamental human rights. The guarantee of this right is based on the fact that modern states have given the courts the role of realizing justice, and have formed and developed a system of courts and judges that fulfills this role independent of any pressure. Therefore, courts must always conduct fair and impartial trials without betraying people's trust in them, and must not neglect or refuse to try formal complaints.
