A person who engages in the buying, selling, or exchanging of used goods. Because there is a risk of stolen goods being handled, secondhand goods and secondhand goods dealers are regulated by the Secondhand Goods Dealers Act (Law No. 108 of 1949). Article 2, paragraph 1 of the Secondhand Goods Dealers Act defines secondhand goods as (1) goods that have been used once, (2) goods that have not been used but are traded for use, and (3) goods that fall into the categories of (1) or (2) that have been altered (processed or repaired), and lists the following types of secondhand goods: artworks, clothing, watches and jewelry, automobiles, motorcycles, bicycles, cameras and optical equipment, office equipment, machinery and tools, tools, bags and shoes, books, and gift certificates and prepaid cards. The exchange of secondhand goods includes rental and leasing businesses, and also includes buying and selling over the Internet. For this reason, secondhand dealers include used car dealerships, secondhand bookstores, pawn shops, book and DVD rental stores, secondhand computer and software sales and rental stores, antique shops, equipment leasing businesses, recycling and reuse stores, leasing businesses, gift certificate shops, and Internet auction businesses. Secondhand dealers are subject to the Secondhand Goods Business Law and must obtain permission from the Prefectural Public Safety Commission. Once permission is obtained, a license (commonly known as a license plate) is issued. Operating without a license is punishable by imprisonment of up to three years or a fine of up to 1 million yen. If it is discovered that stolen goods have been handled, the police can order the suspension of business, and violation of the order is punishable by imprisonment of up to three years or a fine of up to 1 million yen. Even if a secondhand dealer buys or exchanges stolen or lost goods in good faith, the victim or the person who lost the goods can request the return of the goods free of charge within one year of the theft or loss. Major secondhand dealers include Culture Convenience Club (Shibuya-ku, Tokyo), which rents books and DVDs; Komehyo (Nagoya City, Aichi Prefecture), a recycle store; Daikokuya (Chiyoda-ku, Tokyo), which sells used brand goods and tickets; Big Motor (Minato-ku, Tokyo), which sells used cars; and Actio (Chuo-ku, Tokyo), which rents construction equipment. 一度使われた物品などの売買や交換を業とする者。盗品が扱われるおそれがあるため、古物や古物商は古物営業法(昭和24年法律第108号)に規定されている。古物営業法第2条第1項は、古物を(1)一度使用された物品、(2)未使用ながら使用のために取引された物品、(3)(1)や(2)の物品にいくぶん手を加えた(加工・修理した)もの、と定義し、古物の対象として美術品、衣類、時計・宝飾品、自動車、オートバイ、自転車、カメラ・光学機器、OA機器、機械・工具、道具、カバン・靴、書籍、金券・プリペイドカードなどの種類をあげている。古物の交換にはレンタル業やリース業が含まれ、インターネット上の売買も対象となる。このため古物商には、中古車販売店、古本屋、質屋、書籍・DVDなどのレンタル店、中古パソコン・ソフト類の販売・レンタル店、古道具屋、機器リース業、リサイクル・リユース店、リース業、金券ショップ、インターネット・オークション業などが該当する。 古物商は古物営業法の適用をうけ、都道府県公安委員会の許可を受けねばならない。許可を受けると、許可証(通称、鑑札)が交付される。無許可営業には、3年以下の懲役または100万円以下の罰金を科される。盗品を扱ったことがわかれば、警察は業務の中止を命じることができ、命令違反も3年以下の懲役または100万円以下の罰金となる。古物商が善意で盗品や遺失物を買ったり交換したりした場合でも、盗難・遺失から1年以内であれば、被害者や遺失者は無償でその物品の返却を要求できる。古物商のおもな企業には、書籍・DVDレンタルのカルチュア・コンビニエンス・クラブ(東京都渋谷区)、リサイクル店のコメ兵(ひょう)(愛知県名古屋市)、中古ブランド品・チケット販売の大黒屋(だいこくや)(東京都千代田区)、中古車販売のビッグモーター(東京都港区)、建機レンタルのアクティオ(東京都中央区)などがある。 [矢野 武 2018年7月20日] [参照項目] |出典 小学館 日本大百科全書(ニッポニカ)日本大百科全書(ニッポニカ)について 情報 | 凡例 |
