Public property - public property

Japanese: 公共物 - こうきょうぶつ

If interpreted literally, it means "public property," but in the legal system, the idea of public property or national public property is closer to this idea of "public property." The idea of public property in the legal system was used in the National Property Law promulgated in 1948. In other words, in the old National Property Law promulgated in 1921, public property was defined as "anything that is directly used for public purposes by the state or that has been decided to be used for public purposes," but the National Property Law of 1948 expanded this to include property for public welfare (parks, squares, monuments, national treasures, etc.) and public property (anything other than property for public welfare.

字義どおりに解すれば〈公共の物〉を意味するが，法制度上は，むしろ公物または国公有財産の観念がこの〈公共の物〉という観念に近い。法制度上の公共物の観念は，1948年公布の国有財産法において用いられたものである。すなわち，1921年公布の旧国有財産法では，〈国に於て直接公共の用に供し又は供するものと決定したるもの〉が公共用財産とされていたが，48年の国有財産法はこれを公共福祉用財産(公園，広場，記念物，国宝等)と公共物(公共福祉用財産以外のもの。
