Warehouse receipts - Kuranishoken

A type of warehouse receipt. A warehouse operator issues a receipt (single receipt) in place of a deposit receipt and pawn receipt (double receipt) at the request of the depositor. It combines the characteristics of both receipts, and one receipt allows the transfer, pawning, and other disposal of the deposited goods. In that respect, it has the same function as a freight receipt for land transportation. The provisions regarding deposit receipts apply mutatis mutandis to warehouse receipts, but the two differ in the following points. That is, while deposit receipts are used to dispose of the deposited goods other than establishing a pledge, warehouse receipts can also be used to pawn the deposited goods. However, in order to pawn the goods, the holder of the warehouse receipt must enter into a pledge agreement with the creditor and hand over the warehouse receipt to the creditor, so if the depositor pawns the goods using the warehouse receipt, he or she cannot ask for the return of the deposited goods. In actual transactions, warehouse receipts are used exclusively to avoid the complexity of double receipts.

倉庫証券の一種。倉庫営業者が寄託者の請求により、預り証券および質入証券（複券主義）にかえて発行するもの（単券主義）で、両証券をあわせた性質を有し、一つの証券によって寄託物の譲渡・質入れなどの処分行為ができる。その点、陸上運送における貨物引換証と同じ機能を有する。倉荷証券には預り証券に関する規定が準用されるが、次の点で両者は異なる。すなわち、預り証券は、寄託物に対する質権設定以外の処分をなすために利用されるのに対して、倉荷証券はさらに寄託物の質入れのためにも利用される。ただし、その質入れを行うには、倉荷証券の所持人が債権者と質権設定契約を行うとともに、債権者に倉荷証券を引き渡さなければならないから、寄託者は、倉荷証券によって寄託物の質入れをした場合には、寄託物の返還を求めることができないという不便がある。実際の取引では、複券の繁雑さを嫌い、もっぱら倉荷証券が利用されている。
