Law of Settlement and Removal

It is also translated as the Domicile Act, Settlement Act, or Residence Act. It is a piece of legislation that appeared in the history of poor law in the UK and the US, and the series of laws from 1662 onwards in the UK are well known. The background to this legislation is the traditional idea that all residents legally belong to a parish and have various obligations to their parish, but can expect protection from the parish they belong to in times of disaster or poverty. In order to maintain such a relationship between parishes and residents, this series of legislation placed legal restrictions on the movement of poor people who need relief even though they do not contribute to the parish, and workers who could be eligible for relief, and gave each parish the power to refuse new immigrants.

居住地法，定住法，居住法とも訳されている。イギリスおよびアメリカの救貧法史上に現れた立法で，イギリスにおける1662年法以降の一連の法律が有名である。この立法の背景には，すべての住民は法的にいずれかの教区に所属し，住民は教区に対して各種の義務を負うが，災害や貧困という事態に際しては所属する教区からの保護を期待しうるという伝統的な考え方がある。このような教区と住民との関係を維持するために，教区に貢献していないにもかかわらず救済を必要とする貧民や，救済対象となる可能性のある労働者の移動に法的な制限を設け，各教区に新しい移住者を拒否する権限を付与したのが，この一連の立法である。
