Right of residence

Japanese: 居住権 - きょじゅうけん

A concept used to protect the right to live in a house as a necessary right for survival. It is not a legal term. The core of this is the right to live in a house under the Land and House Lease Law. It is particularly significant in terms of protecting residents in the event of the end of a lease relationship, but it does not recognize the rights of those who live in someone else's house without permission. The amendment to the Land and House Lease Law (1966) stipulated that when a tenant dies without an heir, the common-law wife or adopted child who lived with the tenant will inherit the rights and obligations. The amendment to the Land and House Lease Law (1991), which introduced systems such as fixed-term land leases, has been criticized for weakening the protection of the right to live in a house.

家屋に居住することを生存に必要な権利として保護するために用いられる概念。法令上の用語ではない。借地借家法に基づく借家権がその中心をなす。賃貸借関係終了などの場合に居住者を保護する面で特に意義があるが，無断で他人の家屋に居住する者の権利を認めるものではない。借家法改正（1966年）により，賃借人が相続人なしに死亡したとき，賃借人と同居していた内縁の妻・養子などはその権利義務を継承するものとされた。定期借地権などの制度が導入された借地借家法改正（1991年）に対しては，居住権の保障を弱めるものとの批判がある。
