Administrative agency - gyoseikancho

An administrative agency that has the authority to decide and express the will of the nation. This includes ministers, regional tax bureau chiefs, tax office chiefs, the Fair Trade Commission, and the Commissioner of the Social Insurance Agency. When including administrative agencies that have the authority to decide and express the will of local governments (governors, city and town mayors, welfare office chiefs, police chiefs, etc.), they are called administrative agencies. Administrative agencies can become defendants in lawsuits to set aside administrative dispositions (Article 11 of the Administrative Case Litigation Act). For administrative agencies to make decisions, they usually receive assistance from auxiliary agencies and receive opinions from national advisory and participating agencies.

国の意思を決定表示する権限を有する行政機関。大臣、地方国税局長、税務署長、公正取引委員会、社会保険庁長官などがこれにあたる。地方公共団体の意思を決定表示する権限を有する行政機関（知事、市町村長、福祉事務所長、警察署長など）を含めるときは行政庁とよばれる。行政庁は行政処分取消訴訟の被告となる（行政事件訴訟法11条）。行政庁が意思決定をなすには、補助機関の補助を受け、国の諮問機関や参与機関の意見具申を得るのが普通である。
