The International Court of Justice, at the request of the UN General Assembly or the Security Council, provides guidelines for interpretation and action on issues of international law. It is different from a so-called trial (dispute), in which the plaintiff and defendant fight over their respective rights and obligations and decide who wins, but it is not uncommon for a court to use a specific case as the basis and ultimately require the parties to take specific action. The advisory opinion issued on July 9, 2004, on the legal meaning of the "separation wall" being built by Israel in the occupied Palestinian territories, was the 25th advisory opinion issued in total. In response to a consultation made by the UN General Assembly in December 2003, almost all of the 15 judges, except for one from the United States, voted in favor of ruling that the construction of the wall is illegal. In the same month, the UN General Assembly also overwhelmingly adopted a resolution supporting this advisory opinion. Opinions are not binding like court decisions, and the parties are free to follow them or not, but there have been several cases in the past where advisory opinions have served as an opportunity to resolve disputes.

国際司法裁判所が国連総会や安保理の要請に応じて、国際法上の問題について解釈や行動の指針を示すもの。原告と被告がそれぞれの権利義務を争って勝ち負けを決める、いわゆる裁判(争訟)とは異なるが、具体的な事件を下敷きにし、結果的に当事者に具体的な行為を求める例もまれではない。2004年7月9日に出された、イスラエルがパレスチナ占領地域に建設している「分離壁」の法的な意味合いに関する勧告的意見は、通算25番目のもの。03年12月に国連総会が行った諮問に答え、15名の裁判官のうち米国出身の1人を除くほとんど全員の賛成で壁の建設を違法とした。同月、国連総会もこの勧告的意見を支持する総会決議を圧倒的多数で採択。意見には判決のような拘束力がなく、従うか従わないかは当事者の自由だが、これまでにも勧告的意見が紛争解決の契機となった例はいくつかある。
