...In other words, the state must restrict the freedom of property rights in the name of the public welfare and strengthen the social right aspect of family policy that serves the maintenance and development of family life, the right to life. This would be more concrete if the legal basis for family policy was not only the Constitution, but also the Universal Declaration of Human Rights (Articles 12, 16, 22, 23, 25) and the International Covenant on Human Rights (Article 10 of the International Covenant on Human Rights, Article 23 of the International Covenant on Human Rights), and asserted "human rights related to the family" ((1) the right to freedom from unjustified interference with family or family life, (2) the right to the establishment of a democratic family or home, (3) the right to material security for the maintenance of the family or home). In addition, countries that cite the European Convention on Human Rights and the European Social Charter as the legal basis for family policy (such as Austria) are also likely to adopt a similar approach to their own family policy.
