General power relations

The relationship of dominance and submission that generally exists between the state, local governments, and other public organizations and the people or residents. It is a concept of a special power relationship that exists only to the extent necessary for a special purpose. Examples include taxation, land acquisition, police, and building regulations, and it exists only when the principle of administration by law is applied and there is a concrete legal basis.

国家、地方公共団体その他の公共団体と国民、住民との間に一般的に成り立つ支配服従関係。特別の目的のために必要な限度において成立する特別権力関係に対する観念である。課税、土地収用、警察、建築規制などがその例で、法律による行政の原理の適用があり、具体的な法律の根拠がある場合にのみ成り立つ。
