The predecessor of the current bankruptcy system. It was established by the Family Property Dispersion Law (Law No. 69 of 1890) and replaced the previous customary law system known as "ransom" or "dispersion." The family property dispersion system was applicable to ordinary people other than merchants, for whom the old Commercial Code stipulated the bankruptcy system. 現在の破産制度の前身。家資分散法 (明治 23年法律 69号) によって創設されたものであり,それ以前の「身代限」とか「分散」とか呼ばれた慣習法的制度に代ったものである。家資分散の制度は,商人以外の一般人に妥当するものであって,商人については旧商法が破産の制度を規定していた。この2つを統合したものが現行の破産法である。
