Ombudsman - Onbuzuman (English spelling) ombudsman

Originally a Swedish word meaning a representative, it has come to be used widely in other countries as well. Recently, it is often referred to as ombudsman or ombudsperson. In Japan, it is usually translated as kokusei kansatsu kankan (also called gyosei kansatsu senmon-in or gyosei kansatsu shinkan). It is a system established in Sweden in 1809, and is an official position appointed by the Diet to handle complaints made by citizens against government agencies. In Sweden, a military ombudsman was also established in 1915, but in 1968 the two were merged, and three ombudsmen shared the responsibility of investigating complaints against government agencies, including those against the military, and in 1976 there were four ombudsmen, including one chief ombudsman and secretary-general. The Swedish ombudsman has great powers, and can investigate and inspect facilities of central and local governments, including all activities of the police, foreign affairs ministry, and security authorities, nationalized industries, and judges, either at the request of the person himself or on his own initiative. They will not be denied access to any relevant documents and, based on their findings, can make recommendations to relevant government agencies and propose legislative and policy changes to Parliament and/or the Government.

This system has spread to more than a dozen countries, including the Nordic countries, New Zealand, Australia (state level), Canada (state level), the UK, France, Germany, and the US (state and local levels), as the relatively most effective and quickest complaint handling and administrative remedy system, especially since the 1950s. The name of the ombudsman varies from country to country, but it is called the "tribe" in Quebec, the "parliamentary commissioner" in the UK and New Zealand, the "mediature" in France, and the "defence commissioner" in Germany. The jurisdiction and power of the ombudsman vary from country to country. It is usually appointed by the parliament (in France, it is the government), and the jurisdiction and power are generally broad and strong in the Nordic countries, but limited in the UK. The UK and France are the only countries where the public is not allowed to directly bring complaints to the ombudsman, and the UK is the only country where the ombudsman's investigative power is narrowly limited to investigating complaints about administrative malpractice. In Japan, there was an administrative counselor system under the Management and Coordination Agency (now the Ministry of Internal Affairs and Communications) as a complaint handling system, but its authority and procedures were weaker than in Western countries, which led to growing voices from scholars and legal professionals calling for the adoption of an ombudsman system. In the autumn of 1990, several local governments attempted to introduce ombudsman systems or similar systems, starting with the "Citizen Ombudsman" in Kawasaki City and the "Welfare Ombudsman" (Welfare Service Complaints Adjustment Committee) in Nakano Ward, Tokyo. In addition, citizen ombuds, as private voluntary organizations, have been active since 1990, calling for the disclosure of information on local government expenditures and revealing the reality of official entertainment and empty business trips.

もともと代理者を意味するスウェーデン語だが、それ以外の国でも広く用いられるようになっている。また、最近ではこれをオンブズ、オンブズパーソンと言い表すことが多くなっている。日本では通常、国政監察官（行政監査専門員、または行政監察委員ともいう）と訳されている。スウェーデンで1809年に創設された制度で、国会が政府機関に対する国民の苦情を処理するため任命した官職である。この国では1915年に軍事オンブズマンも設置されたが、1968年には両者が統合されて、3人のオンブズマンが軍隊に対する苦情を含めて、政府の行政機関に対する苦情調査の責任を分担することとなり、1976年には1人の主任オンブズマン兼事務局長を含む4人のオンブズマンが置かれることになった。スウェーデンのオンブズマンの権限は強大で、警察、外務省、保安当局のすべての活動を含む中央・地方政府、国有化産業、裁判官などの不当な行動に対して、本人の苦情申立ておよび自らのイニシアティブで調査を行い、施設を査察することができる。またいかなる関連文書への接近も拒否されることはない。そして調査結果に基づいて関連の政府機関に勧告をし、国会ないし政府に対して立法および政策変更の提案をすることができる。

　この制度はとくに1950年代以降、相対的にもっとも有効で手早い苦情処理・行政救済制度として、北欧諸国、ニュージーランド、オーストラリア（州レベル）、カナダ（州レベル）、イギリス、フランス、ドイツ、アメリカ（州・地方レベル）など十数か国に広まっている。もっとも名称はさまざまで、カナダのケベック州では「護民官」、イギリスとニュージーランドでは「議会コミッショナー」、フランスでは、「メディアトゥール」、ドイツでは「防衛コミッショナー」とよばれている。オンブズマンの管轄範囲と権能は国によって異なる。それは、普通、国会によって任命されるが（フランスは政府による）、管轄範囲や権限は、概していえば、北欧諸国などでは広くて強いのに対して、イギリスなどでは制限されている。公衆が直接にオンブズマンに苦情を持ち込むことが許されていない国もイギリスとフランスのみであり、オンブズマンの調査権を過誤行政に関する苦情調査に狭く限定しているのもイギリスのみである。日本では、苦情処理制度として総務庁（現総務省）の行政相談員制度があったが、権限も手続も欧米諸国に比べて弱く、そのためオンブズマン制度の採用を主張する学者や法曹の声が高まっていた。そうしたなかで、1990年（平成2）の秋、川崎市の「市民オンブズマン」、東京都中野区の「福祉オンブズマン」（福祉サービス苦情調整委員会）を皮切りに、いくつかの地方自治体においてオンブズマン制度もしくはこれと類似の制度の導入が図られた。また、民間の自発的組織としての市民オンブズの活動は1990年以降盛んであり、自治体の支出についての情報公開を求めたり、官官接待や空出張などの実態を明らかにしてきた。
