There have been cases where a court has ruled that "if you have a right to the possession of the land, you should sue with evidence," but this is an indication that the principle was that it was prohibited to realize one's rights (recovery of the land) by one's own efforts (self-help), and is not the same as the above-mentioned current Civil Code, where possession suits are treated separately from the main right. On the other hand, there is also a theory that considers the possession of the land to be similar to the medieval German Gewere (called saisine in France), which indicates a form of ownership in which rights and possession are not separated. As can be seen from the above expression "the origin of the possession of the possession," the right and possession are closely related in the case of the possession of the possession, so there are some commonalities with the Gewere system. However, the word Gewere itself is a technical term indicating a certain legal status in the state system, and in court, the issue is who has that status. In contrast, the word "chigyo" refers to the de facto act or state of taking possession of the duties and rights and interests that come with an "office." It is rather the "office" that corresponds to Gewere, the object (status) that should be taken possession of, and one could even say that "chigyo" corresponds to the "haben" in "having Gewere."
