Legislative theory and interpretation theory - Rippouronkaishakuron
Legislative theory is the argument that the wording of statutes should be changed through legislation or new statutes should be established in order to achieve a certain purpose. In contrast, hermeneutical theory is the argument that starts from the wording of existing statutes and is limited to interpretation based on that. Legislative theory and hermeneutical theory are usually distinguished by expressions such as "This is the only way to say it as an interpretive theory, but this is how it should be as a legislative theory," "It may be possible to say it as a legislative theory, but it is impossible as an interpretive theory," or, in response to someone who is arguing something that should be argued in the form of a legislative theory, "That argument goes beyond the bounds of interpretation," but the boundary between the two is not always clear.

一定の目的を実現するために立法によって制定法の文言を変更し,または新たな制定法を設けるべきだとする主張が立法論である。これに対して現在ある制定法の文言から出発してそれに基づく解釈に終始することを解釈論という。通常は,〈解釈論としてはこういわざるをえないが,立法論としてはこうあるべきだ〉〈立法論としてはいえても解釈論としては無理である〉とか,立法論の形で主張すべきものを解釈論の形で主張している者に対して,〈その主張は解釈の枠を超えている〉といった表現によって,立法論と解釈論を区別するが,両者を区別する境界線はつねに明確であるわけではない。
