Wildcat strike

A strike carried out by some members of a labor union without a unified will within the union or regardless of the will of the union as a whole. Because this type of strike is carried out in violation of the procedures set out in the union's regulations, strikers may be subject to sanctions within the union for violating the regulations or discipline. However, opinions are divided as to whether it is unjust in relation to the employer, and the final decision depends on whether the strike itself is in the interest of the workers. This type of strike is rare in Japan, but is common in the UK. Wildcat strikes in the UK occur at the workplace level without the approval of a powerful central organization. However, in France, strikes are considered to be the voluntary actions of individual workers, and wildcat strikes themselves are not allowed.

労働組合の一部の構成員が、組合での意思統一を経ず、あるいは組合全体の意思とは関係なく行うストライキ。このストは、組合規約所定の手続に違反して行われるから、スト参加者は、規約違反あるいは規律違反として組合内部で制裁を科せられることもある。しかし、対使用者との関係において不当か否かは見解が分かれており、その最終判断は、スト自体が労働者の利益に合致するか否かにかかっている。日本ではこのストは少ないが、イギリスでは多発している。イギリスの山猫ストは、強力な中央組織の承認を経ずに職場単位で発生している。しかしフランスでは、ストライキは労働者個人の自発行為とされており、山猫スト自体が存在しえない。
